Fork Farms offers a 14-day return policy on all Flex Farms. Returns must be initiated within 14 calendar days from the date the order was placed. To be eligible for a return, your Flex Farm must be unopened, unused and in the same condition that you received it. The return shipping cost will be deducted from your refund. Your item must be in the original packaging. A receipt or proof of purchase is also required.
Except as otherwise provided, Fork Farms, LLC (“the Company”) warrants that this Flex Farm (“the Covered Product”) shall be free from manufacturing defects or failures, not due to misuse or error in operation, for a period of one year from the date of purchase (“the Warranty Period”).
During the Warranty Period, the Company may, in its sole discretion, repair or replace any defective piece or component of the Covered Product, with parts of like kind and quality. This warranty applies only to original purchasers for value that acquire the Covered Product directly from the Company, its subsidiaries, or its authorized resellers.
ANY MISUSE OF OR MODIFICATION(S) MADE TO THE COVERED PRODUCT, WHETHER SUCH MODIFICATION(S) OCCUR(RED) DURING OR AFTER THE WARRANTY PERIOD, OR OTHERWISE FAILING TO OPERATE THE COVERED PRODUCT ACCORDING TO THE COMPANY’S PUBLISHED INSTRUCTIONS, SHALL IMMEDIATELY VOID ALL WARRANTIES, EXPRESS OR IMPLIED, AND RELEASE THE COMPANY FROM ANY AND ALL LIABILITY ARISING FROM OR RELATED TO THE SAME.
For purposes of this Limited Warranty, the following non-exhaustive list of activities constitute misuse or noncompliance with the Company’s published instructions and will void the warranty on the Covered Product:
1. Term and Commencement
This Agreement shall commence on the date the Flex Micro unit ships and shall remain in effect for a period of twelve (12) months, unless terminated earlier in accordance with this Agreement.
2. Payment Terms
Customer agrees to pay $400 per month for the duration of the contract.
- Payments shall be made via Credit Card or ACH.
- The first payment is due on the shipment date of the Flex Micro unit.
- Monthly payments shall be made on the same calendar day each month thereafter.
3. Included Services
Fork Farms shall provide the following over the 12-month contract term:
- Supplies to grow Microgreens, including:
- 2 lbs of Nutrient A & B
- 32 oz of pH Down
- 624 Microgreen Grow Mats
- $864 in seed credits
- Warranty: Complimentary warranty replacement policy as offered by Fork Farms.
- Support: Standard support package including:
- Business-day support with response time within 1 business day.
- Additional Supplies: Fork Farms agrees to reasonably provide additional growing supplies if needed (e.g., replenishment of nutrients or pH Down), at its discretion and based on usage.
4. Customer Responsibilities
The Customer agrees to:
- Operate the Flex Micro in accordance with all provided operating and maintenance guides.
- Maintain the unit in good working order and avoid misuse or unauthorized modifications.
- Use only Fork Farms-approved supplies and components.
5. End of Term and Equipment Retrieval
If the Customer does not renew this Agreement at the end of the 12-month term, they must allow access to Fork Farms or a Fork Farms-authorized representative to remove the Flex Micro unit from the premises.
- Customer agrees to coordinate retrieval in good faith and provide access within 14 days of the contract end date.
6. Termination
This Agreement may be terminated by Fork Farms upon:
- Non-payment by the Customer beyond 10 business days of due date
- Misuse or neglect of the equipment or supplies
- Violation of terms set forth in this Agreement
7. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the State of [Insert State], without regard to its conflict of law provisions.
8. Entire Agreement
This document constitutes the entire agreement between the parties and supersedes all prior negotiations, understandings, and agreements.
